May 26, 2022 Opinion or Order Filing 9 PAPERLESS ORDER DISMISSING CASE. On May 3, 2022, the Court issued an Order of Referral to Initial Mediation #4 and therein provided Plaintiff's counsel fourteen days to complete and file a proposed order scheduling mediation. Plaintiff's counsel failed to timely file a proposed order scheduling mediation. Therefore, on May 23, 2022, the Court entered an Order providing Plaintiff's counsel until and including May 25, 2022 "to complete and file a proposed order scheduling mediation or show cause why this case should not be dismissed for non-compliance with the Court's Orders." (D.E. 8.) Plaintiff's counsel failed to file a proposed order scheduling mediation, show cause for such failure, or otherwise respond to the Court's order on or before May 25, 2022. Accordingly, it is ORDERED AND ADJUDGED that this case is DISMISSED WITHOUT PREJUDICE for lack of prosecution and failure to comply with the Court's orders, all pending motions are DENIED AS MOOT, and this case is now CLOSED.
