Filing 7 PAPERLESS ORDER. THIS CAUSE came before the Court upon Plaintiff Juan Carlos Arcaya's Notice of Voluntary Dismissal. #6 . Therein, Plaintiff notifies the Court that this case is dismissed without prejudice because the Parties have resolved this matter. Id. at 1. Rule 41(a)(1)(A)(i) of the Federal Rules of Civil Procedure allows a plaintiff to voluntarily dismiss a claim by filing a notice of dismissal before the opposing party serves an answer or a motion for summary judgment. Fed. R. Civ. P. 41(a)(1)(A)(i). Here, Defendant has not filed an answer or motion for summary judgment, or otherwise appeared in this action. Accordingly, UPON CONSIDERATION of the Notice, the pertinent portions of the record, and being otherwise fully advised in the premises, it is hereby ORDERED AND ADJUDGED that the above-styled cause is DISMISSED WITHOUT PREJUDICE.
