The Court cautioned Plaintiff that "[f]ailure to comply with this Order will result in dismissal of this case." To date, Plaintiff has not paid the filing fee or filed a motion to proceed in forma pauperis. Accordingly, this action is dismissed without prejudice. May 23, 2022 Opinion or Order Filing 3 PAPERLESS ORDER REQUIRING PAYMENT OF FILING FEE OR FILING OF MOTION TO PROCEED IFP WITH DETAILED AFFIDAVIT. Plaintiff, proceeding pro se, filed her Complaint in this action on May 18, 2022. Under 28 U.S.C. 1914(a), the Clerk of Court is instructed to require parties instituting a civil action to pay a filing fee. See id. Nevertheless, under 28 U.S.C. 1915(a)(1), any court of the United States may authorize the commencement . . . of any suit, action or proceeding, civil or criminal, . . . without prepayment of fees or security therefor, by a person who submits an affidavit that includes a statement of all assets such prisoner possesses that the person is unable to pay such fees or give security therefor.Id. (alterations added). To date, Plaintiff has not paid the filing fee nor has she submitted a motion to proceed in forma pauperis accompanied by an affidavit satisfying the requirement of poverty. See Martinez v. Kristi Kleaners, Inc., 364 F.3d 1305, 1307 (11th Cir. 2004) (footnote call number and citation omitted); see id. 1306 n.1 (Despite the statute's reference to a "prisoner," "the affidavit requirement applies to all persons requesting leave to proceed IFP.").Accordingly, it is ORDERED AND ADJUDGED that on or before June 6, 2022, Plaintiff shall pay the Clerk's filing fee of $402.00 or, in the alternative, file a motion for leave to proceed in forma pauperis, with supporting financial affidavit.
