PAPERLESS ORDER TO SHOW CAUSE. THIS MATTER is before the Court sua sponte. The Court's November 14, 2022 Order stated: "Plaintiff shall file its response by November 16, 2022. Failure to timely file a response will result in Defendant's Motion to Dismiss being granted, by default. No further extensions of time will be given." Plaintiff failed to file its response until November 17, 2022, which was twenty-three (23) days past the original deadline to respond, and one (1) day past the Court's extended deadline. Accordingly, Plaintiff is ORDERED TO SHOW CAUSE by November 21, 2022 why Defendant's Motion to Dismiss should not be granted by default for Plaintiff's failure to comply with a Court Order. THIS MATTER is before the Court sua sponte. #22 The Scheduling Order in this matter states that, "[w]ithin thirty (30) days of the date of this Order, the Parties shall: select a mediator certified under [Southern District of Florida] Local Rule 16.2(b); schedule a time, date, and place for mediation; and jointly file a notice scheduling mediation...." However, upon review of #25 , #26 the notices of mediation, it does not appear that the proposed mediator (Laura Bonn) is certified as a mediator in the Southern District of Florida. The Southern District of Florida's Certified Mediator List is available at #https://www.flsd.uscourts.gov/mediation. Accordingly, it is ORDERED AND ADJUDGED that on or before November 18, 2022, the Parties shall file a joint notice on the docket stating: (1) whether Laura Bonn is certified as a mediator in the Southern District of Florida; (2) if Laura Bonn is certified as a mediator in the Southern District of Florida, why her name does not appear on the Certified Mediator List; and (3) if Laura Bonn is not certified as a mediator in the Southern District of Florida, why the Parties selected an uncertified mediator without first seeking leave of Court to do so. Going forward, all motions and filings by the Parties must comply fully with the Federal Rules of Civil Procedure, the Local Rules for the Southern District of Florida, and the Practices and Procedures of this Court.
