THIS MATTER is before the Court sua sponte. #17 The Scheduling Order in this matter states that, "[w]ithin thirty (30) days of the date of this Order, the Parties shall: select a mediator certified under [Southern District of Florida] Local Rule 16.2(b); schedule a time, date, and place for mediation; and jointly file a notice scheduling mediation...." However, upon review of #25 the Parties' Joint Notice of Mediation, it does not appear that the proposed mediator (Rodney Max) is certified as a mediator in the Southern District of Florida. The Southern District of Florida's Certified Mediator List is available at #https://www.flsd.uscourts.gov/mediation. Accordingly, it is ORDERED AND ADJUDGED that on or before October 3, 2022, the Parties shall file a joint notice on the docket stating: (1) whether Rodney Max is certified as a mediator in the Southern District of Florida; (2) if Rodney Max is certified as a mediator in the Southern District of Florida, why his name does not appear on the Certified Mediator List; and (3) if Rodney Max is not certified as a mediator in the Southern District of Florida, why the Parties selected an uncertified mediator without first seeking leave of Court to do so. Going forward, all motions and filings by the Parties must comply fully with the Federal Rules of Civil Procedure, the Local Rules for the Southern District of Florida, and the Practices and Procedures of this Court.
