PAPERLESS ORDER DISMISSING AND CLOSING CASE. THIS MATTER is before the Court on a sua sponte review of the record. On September 14, 2022 this Court entered an Order #4 stating that "Plaintiffs counsel shall file with the Clerk of the Court a verified response to this order WITHIN TEN (10) DAYS from the date of this order" regarding any prior litigation involving Defendant under the ADA. (Emphasis original.) The Order also states "Non-compliance with any provision of this Order, the Federal Rules of Civil Procedure, the Local Rules, or this Court's Practices and Procedures... may subject the offending party to sanctions, including dismissal of this case." (Emphasis original.) In addition, district courts are vested with "broad discretion... to manage their dockets...."See Watts v. Club Madonna, Inc., et al., 784 F. App'x 684, 688 (11th Cir. 2019) (quotation, citation omitted). To date, Plaintiff has neither filed a verified response nor a motion for an extension of time to do so. Accordingly, upon a review of the record and on the Court's discretion to manage its docket, it is ORDERED AND ADJUDGED that this matter is DISMISSED WITHOUT PREJUDICE and the Clerk is directed to CLOSE the case.
