On December 5, 2022, the Court entered #10 the Scheduling Order in this matter, which states in relevant part:WITHIN THIRTY (30) DAYS of the date of this Order, the Parties shall: (1) select a mediator certified under Local Rule 16.2(b); (2) schedule a time, date, and place for mediation; and (3) jointly file a notice scheduling mediation....On December 22, 2022, the Parties filed #12 the Joint Mediation Notice, designating Steven Jaffe as their Mediator. Having reviewed the Southern District of Florida's Certified Mediator List, Steven Jaffe's name does not appear on the list. The Certified Mediator List is available online at #https://www.flsd.uscourts.gov/mediation.Accordingly, it is ORDERED AND ADJUDGED as follows: #12 The Parties' Joint Mediation Notice is STRICKEN from the recor d.On or before January 3, 2023, the Parties shall jointly file a notice on the docket, stating: (1) whether Steven Jaffe is certified as a mediator in the Southern District of Florida; (2) if Steven Jaffe is certified, why their name does not appear on the Certified Mediator List; and (3) if they are not certified, why the Parties selected an uncertified mediator in violation of #10 the Scheduling Order, without first seeking leave of Court to do so.If Steven Jaffe is not certified as a mediator in the Southern District of Florida, but the Parties nonetheless intend for Jaffe to serve as their mediator in this matter, they should style the notice as a motion for leave of Court to select an uncertified mediator and attach as an exhibit documentation establishing Jaffe's qualifications to serve as a mediator in this matter (e.g., a CV or resume).Moving forward, the Court advises the Parties that they must fully comply with the Federal Rules of Civil Procedure, the Local Rules for the Southern District of Florida, the Court's Practices and Procedures, and all Court orders.
