THIS CAUSE came before the Court upon Plaintiffs' Unopposed Motion to Dismiss, which the Court construes as a notice of voluntary dismissal pursuant to Rule 41(a) of the Federal Rules of Civil Procedure. See #7 . Plaintiffs request that this matter be dismissed with prejudice because USCIS approved Plaintiffs' I-130 petition. See id. Rule 41(a)(1)(A)(i) of the Federal Rules of Civil Procedure allows a plaintiff to voluntarily dismiss a claim prior to a defendant's filing of an answer or a motion for summary judgment. Fed. R. Civ. P. 41(a)(1)(A)(i). In this case, neither an answer nor a motion for summary judgment has been filed. Accordingly, UPON CONSIDERATION of the Motion, the pertinent portions of the record, and being otherwise fully advised in the premises, it is ORDERED AND ADJUDGED that the above-styled cause is hereby DISMISSED WITH PREJUDICE.
