Filing 8 PAPERLESS ORDER. THIS CAUSE came before the Court upon Plaintiffs' Unopposed Motion to Dismiss, which the Court construes as a notice of voluntary dismissal pursuant to Rule 41(a) of the Federal Rules of Civil Procedure. See #7 . Plaintiffs request that this matter be dismissed with prejudice because USCIS approved Plaintiffs' I-130 petition. See id. Rule 41(a)(1)(A)(i) of the Federal Rules of Civil Procedure allows a plaintiff to voluntarily dismiss a claim prior to a defendant's filing of an answer or a motion for summary judgment. Fed. R. Civ.
