March 19, 2021 Opinion or Order Filing 22 ORDER granting #19 Motion to Extend Time. In this action involving alleged violations of the Telephone Consumer Protection Act and the Fair Debt Collection Practices Act by an unknown defendant, the plaintiff seeks an extension of time "under Federal Rule of Civil Procedure #4 to serve a third (3rd) Rule 45 subpoena" on the defendant's voice over internet protocol (VoIP) telephone carrier in an effort to determine the defendant's identity. This court previously granted the plaintiff's motion to allow limited expedited discovery for this purpose. See ECF No. 12. Bearing in mind that a pro se plaintiff's pleadings must be liberally construed, see Donovan v. Maine, 276 F.3d 87, 94 (1st Cir. 2002), I interpret the plaintiff's motion as a request to extend the time for service of process pursuant to Fed. R. Civ. P. 4(m). Although the motion was filed one day after the service of process deadline expired on March 15, 2021, the plaintiff has submitted exhibits detailing his ongoing communications with the VoIP carrier and demonstrating his diligent efforts to ascertain the defendant's identity. Based on these exhibits, I find good cause to GRANT the motion and EXTEND the deadline for service of process nunc pro tunc to May 18, 2021. By MAGISTRATE JUDGE JOHN H. RICH III.
