Defendants represent that USCIS reopened Plaintiff's application for adjustment of status. Defendants move to stay the proceedings pending USCIS's final agency determination on Plaintiff's application. Defendants' Motion represents that Plaintiff's counsel agrees that a stay of this action is appropriate. Accordingly, this case is STAYED for a period of 30-days. Any Party may move to reopen the case before July 14, 2023. Defendants shall file a status report regarding Plaintiff's pending application on or before July 14, 2023. May 2, 2023 Opinion or Order Filing 8 PAPERLESS ORDER. THIS CAUSE came before the Court upon a sua sponte review of the record. On April 25, 2023, this Court issued its Paperless Order Requiring Response (ECF No. 6). Therein, the Court required the Parties to "inform the Court whether they consent to jurisdiction by Magistrate Judge Louis to take all necessary and proper action as required by law, including, if necessary, a jury or non-jury trial and entry of final judgment." Id. The Court required a response on or before April 28, 2023. Id. That date has since passed, and no response has been filed by either Party. Accordingly, Plaintiff is ORDERED TO SHOW CAUSE on or before Monday, May 8, 2023 as to why the Court should not dismiss this matter for failure to prosecute. Signed by Judge K. April 27, 2023 Opinion or Order Filing 7 PAPERLESS ORDER. THIS CAUSE came before the Court upon a sua sponte examination of the record. As described in this matter's Paperless Order Referring Case, a United States Magistrate Judge has been assigned to this matter as a referral Judge for all purposes, including the entry of a Report and Recommendation on all pre-trial, non-dispositive matters and the entry of a Report and Recommendation on any dispositive matters. Yet, if agreed, the Parties may consent to the Magistrate Judge's handling of the case in its entirety by completing a consent form found on the Court's website. Consent streamlines the legal process because the legal standard of review is identical at all levels in the judicial review process. If the Parties consent to have the case handled by a U.S. Magistrate Judge, then the Magistrate will enter a final decision and judgment in due course. Any appeal of this judgment must be taken directly to the Eleventh Circuit Court of Appeals. If the Parties do not consent, then the Magistrate Judge will submit a Report and Recommendation to the undersigned U.S. District Judge, who will then enter a final decision and judgment. Any appeal from that judgment is also taken to the Eleventh Circuit. Should the Parties agree to consent, they may do so through the filing of a completed Consent to Magistrate Jurisdiction form.
