PAPERLESS ORDER DISMISSING CASE. THIS CAUSE is before the Court on Plaintiff's #9 Notice of Settlement, filed June 1, 2023. Therein, Plaintiff indicates that the Parties have reached a settlement and requests thirty days to file dismissal papers. Accordingly, it is ORDERED AND ADJUDGED that this case is DISMISSED without prejudice, all pending motions are DENIED AS MOOT, and this case is now CLOSED. Within thirty days from the date of this Order and upon the filing of a stipulation of dismissal with prejudice or the filing of an appropriate joint motion and a fully-executed Settlement Agreement, the Court may amend this Order to dismiss the above-captioned action with prejudice, to approve the settlement if filed, and/or to retain jurisdiction over the Agreement, if filed. The Parties are advised that the Court does not retain jurisdiction over a settlement agreement without the Parties having filed the settlement agreement with the Court and, absent good cause, the Court does not review proposed settlement agreements for approval in camera. PAPERLESS ORDER TO SHOW CAUSE. THIS CAUSE is before the Court upon a sua sponte review of the record. On April 19, 2023, the Court issued an #4 Order Requiring Certificate of Counsel Regarding any Prior Filings Under the Americans with Disabilities Act. Therein, the Court provided Plaintiff's counsel until April 26, 2023, to file a verified statement indicating, inter alia, whether a prior law suit alleging violations of the ADA has been filed against the same Defendants or their property. To date, Plaintiff's counsel has failed to file the verified statement. Accordingly, Plaintiff's counsel shall have until and including May 1, 2023, to file the Certificate Regarding Any Prior Filings Under the Americans with Disabilities Act or show cause why this case should not be dismissed for failure to comply with the Court's order.
