Filing 10 PAPERLESS ORDER. THIS MATTER is before the Court on Plaintiff's Motion to Remand (DE #4 ) ("Motion"), filed on May 26, 2023. Plaintiff requests that the Court remand this matter because "Defense counsel as the removing party has failed to comply with this Honorable Court's Order," in that Defendant "failed to file a timely Removal Status Report and failed to file a timely Notice with all relevant state court pleadings." The Court notes Defendant filed its Removal Status Report (DE #5 ) ("Report") and its Notice of Filing Index of State Court Entries (DE #6 ) ("Index of State Court Entries") one day after the deadline set by the Court. However, the Court will not remand based on Defendant's untimely--by one day--submission. Nevertheless, Defendant shall take notice that, as set forth in the Order of Referral and Notice of Court Practice in Removal Cases (DE #3 ), any further "[n]on-compliance with any provision of this [Court's] Order, the Federal Rules of Civil Procedure, the Local Rules for the Southern District of Florida, and/or this Court's Practices and Procedures... may subject the offending Party to sanctions, including dismissal of this case."
