PAPERLESS ORDER. The Defendant told us that it was served with the state-court complaint on May 22, 2023. See Notice of Removal [ECF No. 1] at 1. The Defendant then removed this case on June 20, 2023. See ibid. The Defendant's response to the complaint was thus due on June 27, 2023. See Fed. R. Civ. P. 81(c) ("A defendant who did not answer before removal must answer or present other defenses or objections under [the Federal Rules] within the longest of these periods: (A) 21 days after receiving--through service or otherwise--a copy of the initial pleading stating the claim for relief; (B) 21 days after being served with the summons for an initial pleading on file at the time of service; or (C) 7 days after the notice of removal is filed."). That deadline has now passed, and the Defendant hasn't filed an answer, a motion to dismiss, or a motion for extension of time to do so. Accordingly, by July 13, 2023, the Plaintiff must file a motion for clerk's entry of default. In the meantime, we'll CLOSE this case for administrative purposes. Signed by Judge Roy K. PAPERLESS ORDER. The Parties filed a Joint Scheduling Report (the "Report") [ECF No. 10] pursuant to our Order Requiring Removal Status Report and Joint Scheduling Report [ECF No. 8]. There are two problems with the Report, though. First, the Parties failed to attach their proposed scheduling order, as required by Local Rule 16.1(b)(3). Second, we don't understand the Parties' statement that they "consent to the referral of any additional matters to the Magistrate Judge." Report at 2. Accordingly, by July 7, 2023, the Parties must file an amended joint scheduling report that both attaches a proposed scheduling order as required by the Rules and tells us whether the Parties consent to the Magistrate Judge ruling on dispositive motions or presiding over trial.
