On September 7, 2023, the Plaintiff filed an Affidavit of Service showing that she served the Defendant, Big Lots Stores, LLC, on August 29, 2023. See Affidavit of Service #8 . Rule 12 of the Federal Rules of Civil Procedure provides that a defendant must serve an answer within 21 days after being served with the summons and complaint. The Defendant's response to the Complaint, therefore, was due on September 19, 2023. That deadline has passed, and the Defendant hasn't responded to the Complaint, requested an extension of time, or otherwise appeared in the case at all. See generally Docket. So, by September 28, 2023, the Plaintiff must do one of two things: either move for Clerk's Entry of Default to begin default final judgment procedures or file a notice of voluntary dismissal.
