PAPERLESS ORDER. We've considered the Plaintiff's request for leave to amend her short-form complaint. See generally #15 Joint Scheduling Report. We're not persuaded by the Defendants' position. Nor do we need additional briefing. As the Defendants point out, the transferor court noted in the Transfer Order that "[a]ll deadlines for Plaintiffs to amend their individual complaints without leave of court have passed." Id. at 6 (quoting #6 Judge Milazzo's Case Management Order No. 39 at 4 (emphasis added)). The transferor court thus left it to us to decide whether to grant leave to amend. See WasteCare v. Harmony Enter., Inc., 822 F. App'x 892, 896 n.3 (11th Cir. 2020) ("The decision whether to grant leave to amend is committed to the sound discretion of the trial court." (quoting Espey v. Wainwright, 734 F.2d 748, 750 (11th Cir. 1984))). We'll therefore allow the Plaintiff to file a motion for leave to amend her short-form complaint, though she'll have less time to do so than she requested. We also won't follow the Defendant's suggestion that we "not enter a scheduling order at this time but instead permit the depositions of Plaintiff and her prescribing oncologist" and then permit "early dispositive motion practice on statute of limitations and learned intermediary grounds."
