January 2, 2024 Opinion or Order Filing 12 PAPERLESS ORDER TO SHOW CAUSE The Court has reviewed this record and the filings therein. Although it is not entirely clear, it appears that the complaint seeks relief (in part at least) concerning an ongoing bankruptcy matter and activity in that bankruptcy case. It is unclear what the status of that matter is, but adverse rulings in bankruptcy court are subject to appeal of right, both at the District Court level and at the Court of Appeals. The undersigned of course does not sit as a court of review of the underlying bankruptcy proceeding and would be powerless to do so. There is also a process whereby the District Court may certify a bankruptcy appeal immediately to the Court of Appeals, bypassing District Court review. No later than February 2, 2024 the Plaintiff shall file a pleading and show cause why this matter shall not be stayed pending full completion of the underlying litigation in bankruptcy court and completion of appeals from any final orders there. Plaintiff is cautioned that failure to show cause on these merits by that date shall result in dismissal of this matter with prejudice. Until such time as this Court rules on this show cause matter, all other activity in the present, instant matter here is STAYED. Show Cause Response due by 1/26/2024.
