February 12, 2024 Opinion or Order Filing 10 PAPERLESS ORDER DISMISSING CASE. THIS CAUSE is before the Court on Plaintiff's #9 Notice of Settlement, filed February 8, 2024. Therein, Plaintiff indicates that the Parties have reached a settlement and requests that the Court allow 45 days for the Parties to finalize all settlement documents before dismissing the case. It is standard practice for the Court to dismiss a case without prejudice upon a Notice of Settlement; however, the Parties may file a motion to vacate the dismissal in the event the settlement is not finalized. Accordingly, it is ORDERED AND ADJUDGED that this case is DISMISSED without prejudice, all pending motions are DENIED AS MOOT, and this case is now CLOSED. Within 45 days from the date of this Order and upon the filing of a stipulation of dismissal with prejudice or the filing of an appropriate joint motion and a fully-executed Settlement Agreement, the Court may amend this Order to dismiss the above-captioned action with prejudice, to approve the settlement if filed, and/or to retain jurisdiction over the Agreement, if filed. The Parties are advised that the Court does not retain jurisdiction over a settlement agreement without the Parties having filed the settlement agreement with the Court and, absent good cause, the Court does not review proposed settlement agreements for approval in camera.
