By no later than Thursday, November 9, 2023, Ponte must identify by name the other subpoena recipients who fit this description and file a memorandum of law (supported by pertinent legal authority) addressing why it has standing to move to quash the subpoena issued to Asia Condominium Association, Inc. and the to-be-identified subpoena recipients. By no later than Thursday, November 30, 2023, the Applicants (Valentina Mata Gonzalez, Alejandra Mata Gonzalez, and Maryan Carolina Mata Gonzalez) will file a response memorandum addressing both the #11 motion to vacate and the to-be-filed legal memorandum on standing. Ponte may file an optional reply by no later than Thursday, December 7, 2023. Either party may include evidentiary support (including declaration(s) or affidavit(s)) as exhibits to their filings. The Court acknowledges the assertion in the Application that: "there is, upon information and believe, a substantial risk that Mr. Mata's second wife, Mariolga Azprua Delgado[,]... will continue in her efforts to dissipate or otherwise dispose of Mr. Mata's assets and property without the Applicants' knowledge and consent. Id. at 2. However, attorney Richard C. Lorenzo's declaration filed in support of the instant #1 Application attests that: "Prior to the filing of this Application, I provided notice of the Application via electronic mail to (i) Juan Carlos Trivella, counsel for Mariolga Azprua Delgado in Venezuela, and (ii) Ignacio Torterola, counsel for Mariolga Azprua Delgado in the Arbitration filed by Applicants before the International Chamber of Commerce." [ECF No. 1-3, 3].Given that counsel for Mariolga Azprua Delgado are aware of the instant proceedings, Applicants will, by no later than Thursday, October 12, 2023, file under seal a notice explaining the justification for the continued sealed status of these proceedings.
