March 15, 2024 Opinion or Order Filing 13 PAPERLESS ORDER granting #12 Plaintiff's Motion for Extension of Time to File Dismissal Documents. In an earlier 11 Order, the Undersigned struck Plaintiff's request for an extension of time due to his failure to comply with Judge Williams' 48-hour rule and his failure to include a certificate of conferral. Plaintiff's new motion indicates that the parties have conferred and that Defendant does not oppose the motion. Accordingly, by no later than April 15, 2024, Plaintiff shall file a notice of voluntary dismissal or the parties shall file a joint stipulation of dismissal. March 14, 2024 Opinion or Order Filing 11 PAPERLESS ORDER striking #10 Plaintiff's MOTION for Extension of Time to file Dismissal Documents by Howard Cohan. Plaintiff seeks a 30-day extension of time "to file the required dismissal documents." The Undersigned strikes Plaintiff's motion for two reasons. First, the dismissal paperwork is due tomorrow. Therefore, the instant motion fails to comply with Judge Williams' 48-hour rule. See Judge Williams' Court Practices and Procedures (available at the Court's website: https://www.flsd.uscourts.gov/content/judge-kathleen-m-williams).Second, although the motion states that Plaintiff "moves this Court to enter an Order to an agreed enlargement of time" (emphasis added), there is no indication in the motion that Plaintiff in fact conferred with Defendant's counsel and that counsel agrees to the requested extension. Therefore, the instant motion also fails to comply with Local Rule 7.1(a)(3). February 16, 2024 Opinion or Order Filing 9 PAPERLESS ORDER. THIS MATTER is before the Court on the notice indicating that the Parties have reached a settlement of this matter. (DE #8 .) Accordingly, it is ORDERED AND ADJUDGED that on or before March 15, 2024, Plaintiff shall file a notice of voluntary dismissal or the Parties shall file a joint stipulation of dismissal. See Fed. R. Civ. P. 41(a)(1). The dismissal of this matter is effective and self-executing upon the filing of either Plaintiff's notice of voluntary dismissal or the Parties' joint stipulation of dismissal. However, if the Parties wish for the Court to retain jurisdiction to enforce the settlement agreement, they are advised that they must file the settlement agreement for review and file a joint stipulation of dismissal that complies with the Eleventh Circuit's holding in Anago Franchising, Inc. v. Shaz, LLC, 677 F.3d 1272 (11th Cir. 2012). All hearings and deadlines are CANCELED. All pending motions are DENIED AS MOOT. This case is CLOSED for administrative purposes.
