March 19, 2024 Filing 4 PAPERLESS ORDER granting #3 MOTION for Leave to Proceed in forma pauperis. The motion states that "Plaintiff is currently incarcerated with no assets or income" and "her inmate trust account has not exceeded $250.00 in the past six months." The current balance is $46.50. Based on the financial information provided, Plaintiff's motion is granted. Nonetheless, because Plaintiff is in custody, she "shall be required to pay the full amount of a filing fee." 28 U.S.C. 1915(b)(1); see also Olrich v. Comm'r of Soc. Sec. Admin., No. 17-CV-0486-BHL, 2021 WL 1117271, at *1 (E.D. Wis. Mar. 24, 2021) ("A prisoner plaintiff proceeding in forma pauperis is required to pay the full amount of the... filing fee over time." (citing 28 U.S.C. 1915(b)(1)). Thus, Plaintiff shall owe $405.00, which Plaintiff must pay to the Clerk of Court as funds become available. Plaintiff is assessed an initial partial filing fee of $15.89 (20% of the average monthly deposits in Plaintiff's inmate Trust Fund Account for the preceding six months as required by 28 U.S.C. 1915(b)(1)(A)). Plaintiff has until April 18, 2024, to submit the initial partial filing fee. Plaintiff's failure to pay the initial partial filing fee as instructed may result in a dismissal without prejudice of this action. After payment of the initial partial filing fee, Plaintiff is "required to make monthly payments of 20 percent of the preceding month's income credited to the prisoner's account." 28 U.S.C. 1915(b)(2). To effectuate the payments, the agency with custody over the Plaintiff must forward these payments from Plaintiff's prisoner account to the Clerk of Court anytime the account balance exceeds $10.00. That agency shall continue to make these payments until the Plaintiff has paid the filing fee in full. The Clerk SHALL send a copy of this Order to the Florida Department of Corrections, 501 South Calhoun St., Tallahassee, FL 32399-2500, Attention: Agency Clerk and this Court's Financial Department and file a notice of compliance on CM/ECF.
