ORDER TO SHOW CAUSE. "In all cases removed from any State court to any district court . . . in which any one or more of the defendants has not been served with process or in which the service has not been perfected prior to removal, or in which process served proves to be defective, such process or service may be completed or new process issued in the same manner as in cases originally filed in such district court." 28 U.S.C. 1448. Service of process in federal court is governed by Federal Rule of Civil Procedure 4. Rule 4(m) provides that, "[i]f a defendant is not served within 90 days after the complaint is filed, the court . . . must dismiss the action without prejudice as to that defendant[.] But if the plaintiff shows good cause for the failure, the court must extend the time for service for an appropriate period."The [1-2] Complaint was filed in state court on July 29, 2024, and removed on October 17, 2024. According to the #1 Notice of Removal, as of October 17, 2024, only one Defendantthe City of Miami Beachhad been served. Since the Complaint was filed on July 29, 2024, the Plaintiff had to serve all Defendants by October 28, 2024. If she did serve them, she hasn't proven it by filing the returns of service on the docket. To this day, it appears that only the City of Miami Beach has been timely served. We therefore order the Plaintiff to show, by December 13, 2024, why we should not dismiss the other Defendants from this case. If she timely served them, she must file proof on the docket. If she untimely served them, she must show good cause for her delay. If the Plaintiff does not comply with this Order by December 13, 2024, we will dismiss this action under Rule 41(b).
