PAPERLESS ORDER Requiring Supplementation. Petitioner PDV USA, Inc. moves to compel Respondent David Rivera to produce responsive documents to Petitioner's subpoena within his possession, including the documents described in the Indictment in the criminal proceeding against Respondent in this District and the documents produced by the Government in the same. (ECF Nos. 1, 20). Respondent objects in part because of a protective order entered in the criminal proceeding. Southern District of Florida Local Rule 7.1(a)(3) requires that prior to filing a motion, counsel for the movant shall confer, or make reasonable effort to confer, "with all parties or non-parties who may be affected by the relief sought in the motion." S.D. Fla. L.R. 7.1(a)(3) (emphasis added). While Petitioner conferred with Respondent regarding the instant Motions, Petitioner does not certify conferral with the Government who is party to the protective order and whose production Petitioner seeks. Accordingly, and by April 5, 2024, Petitioner is ORDERED to file an amended certificate of conferral indicating the Government's position on its Motions, (ECF Nos. 1, 20).
