Filing 15
PAPERLESS ORDER Denying #12 Motion to Reopen Case and Reinstate Complaint ("Motion to Reopen") and Striking #13 Motion for Leave to Proceed In Forma Pauperis ("IFP Motion"); #14 Supplemental Affidavit in Support of In Forma Pauperis Application ("Affidavit"). Plaintiff's Motion to Reopen, [ECF No. 12], requests that the Court reconsider its prior Order dismissing Plaintiff's Amended Complaint ("Dismissal Order"), [ECF No. 11], reinstate the Amended Complaint, [ECF No. 8], and allow Plaintiff to proceed in forma pauperis, citing Federal Rule of Civil Procedure 60. Under Rule 60(b), a court may relieve a party from a final judgment, order, or proceeding if there is a showing of mistake, fraud, inadvertence, misconduct, newly discovered evidence, if the judgment is void, or for "any other reason that justifies relief." Fed. R. Civ. P. 60(b). But Plaintiff provides no basis under Rule 60 for why the Court should reconsider its prior Dismissal Order. Further, because the Court dismissed this action in full on March 20, 2025, see [ECF No. 11], there is no further action to be taken in this matter. Accordingly, the Motion to Reopen, [ECF No. 12] is DENIED, the IFP Motion, [ECF No. 13], is STRICKEN, and the Affidavit, [ECF No. 14], is STRICKEN. See Z.K. Marine Inc. v. M/V Archigetis, 808 F. Supp. 1561, 1563 (S.D. Fla. 1992) ("It is an improper use of the motion to reconsider to ask the Court to rethink what the Court already thought through--rightly or wrongly.") (internal alterations and quotation omitted). Signed by Judge Rodolfo A. Ruiz, II on 4/15/2025. (jgz)
