PAPERLESS ORDER GRANTING #10 Unopposed Motion to Vacate Default and DIRECTING the Clerk of Court to VACATE the Clerk's Entry of Default #8 as to both Defendants, RC Home Showcase, Inc. ("RC Home") and Facade Dynamics, LLC. That's because "[t]he time for each Defendant to answer or respond by motion to the complaint begins to run once all Defendants have either been served or waived service." Multiple Defendants Order [ECF No. 6] at 1. And the Plaintiff still hasn't submitted proof that it's served the two individual Defendants, Henry Fabian Kronfle Kozhaya and Manuel Antonio Kronfle Kozhaya. See generallyDocket. An order to show cause to serve these Defendants will follow. We'll add, though, that the Defendant Facade Dynamics, LLC still hasn't filed a notice of appearance by counsel on the docket. And we've already ordered that "[e]ach Defendant timely served by the Plaintiff must file a notice of appearance within 21 days of service." Mult. Defs. Order at 1. That deadline has long passed for Facade Dynamics, LLC. See Affidavit of Service [ECF No. 5] at 1 (certifying that service was effected for Facade Dynamics, LLC, on March 26, 2025). Since "a[n] [LLC] is an artificial entity that can act only through agents, [it] cannot appear pro se, and must be represented by counsel." Palazzo v. Gulf Oil Corp., 764 F.2d 1381, 1385 (11th Cir. 1985). So, Facade Dynamics, LLC must file a notice of appearance by counsel by June 27, 2025.
