PAPERLESS ORDER. THIS CAUSE is before the Court on Plaintiff's Motion for Leave to File Sur-Reply to Defendant City of Miami Beach's (the "City") Reply in Support of Motion to Dismiss (the "Motion"), ECF No. #21 . In the Motion, Plaintiff seeks leave to file a sur-reply to address two arguments that she claims the City raises for the first time in its Reply. See ECF No. #21 . Specifically, she seeks to address the City's reliance on Vega v. Tekoh, 597 U.S. 134 (2022) and to address the City's argument that "amendment is barred," and she explains that "[a] sur-reply is necessary to clarify these mischaracterizations." Id. However, upon review of the Plaintiff's Response and the City's Reply, neither of these are arguments raised for the first time in Reply, which would allow for the filing of a sur-reply. Rather, both of these arguments in the Reply are intended to rebut specific arguments that Plaintiff raised in her Response. Indeed, the City's reliance on Vega was in response to Plaintiff's argument that Officer Porro, a City police officer, violated her constitutional rights through interrogation. See ECF No. #15 at 4. Similarly, the City's argument regarding Plaintiff's request to amend the Complaint addresses Plaintiff's Response wherein she asks that the Court "[g]rant leave to amend if any claims are deficient, correcting clerical errors (e.g.,Count VI labels)." Id. at 7. Thus, neither of these arguments were raised for the first time in the Reply, making a sur-reply unnecessary. Accordingly, the Motion, ECF No. #21 , is DENIED.
