Accordingly, it is ORDERED AND ADJUDGED that on or before October 20, 2025, the Parties shall file a joint stipulation of dismissal. If the Parties wish for the Court to retain jurisdiction beyond the filing of their joint stipulation, they are advised that they must file the settlement agreement for review and any stipulation must comply with the Eleventh Circuit's holding in Anago Franchising, Inc. v. Shaz, LLC, 677 F.3d 1272 (11th Cir. 2012). Otherwise, the dismissal of this matter is effective and self-executing upon the filing of the Parties' joint stipulation of dismissal. Id. | Filing 9 PAPERLESS ORDER granting #8 Unopposed MOTION for Extension of Time to File a Responsive Pleading to the #1 Complaint by Sun Commodities Inc. ("Defendant"). The motion represents that "Defendant's responsive pleading to Plaintiff's Complaint is currently due on or before June 6, 2025." Id. at 1. But the #6 return of service reflects that Defendant was served on April 29, 2025. The response was therefore due on May 20, 2025. Thus, the instant motion fails to comply with Judge Williams' 48-hour rule. See Judge Williams' Court Practices and Procedures (available at the Court's website: https://www.flsd.uscourts.gov/content/judge-kathleen-m-williams). The motion explains that counsel was retained yesterday but is not being filed nunc pro tunc or otherwise explain why Defendant waited so long to obtain counsel. Additionally, it contains an incorrect representation concerning when Defendant's response was due. Perhaps Plaintiff's counsel provided an informal "enlargement" of time for Defendant to answer, but that hypothetical scenario is not mentioned in the motion. Moreover, even if it happened, Defendant would still need to file a motion (albeit an unopposed or agreed motion) for an enlargement of time.Defense counsel shall, by June 6, 2025, file an affidavit or declaration explaining why the motion contains a misrepresentation and what steps will be taken to make sure that other misrepresentations are not made to this Court.In the future, counsel should be more careful in making representations to the Court. See Advanced Diabetes Treatment Centers, LLC v. Sebelius, No. 09-61698, 2012 WL 5077155, at *8 n.8 (S.D. Fla. Sept. 20, 2012), report and recommendation adopted sub nom. Advanced Diabetes Treatment Centers, L.L.C. v. Sebelius, No. 09-61698, 2012 WL 5062415 (S.D. Fla. Sept. 27, 2012) ("The Undersigned anticipates that all counsel will check the accuracy of any representations made to the court, as the court relies on such representations.").Nonetheless, because the instant motion is unopposed, the Undersigned will exercise my discretion and grant the relief requested. Defendant will have until June 27, 2025 to file on CM/ECF its response to Plaintiff's #1 Complaint.
