THIS MATTER is before the Court on Plaintiff's Motion for Reconsideration ("Motion") (DE #55 ) filed fourteen days after the Court denied the Parties' Joint Motion for Extension of Time (DE #53 ). Upon review of the Motion, the record, and applicable law, it is ORDERED AND ADJUDGED that Plaintiff's Motion is GRANTED IN PART. Plaintiff shall disclose experts, expert witness summaries and reports by October 15, 2025. Defendant shall disclose experts, expert witness summaries and reports by October 29, 2025. The Parties shall exchange rebuttal expert witness summaries and reports by November 12, 2025. The Court will sua sponte extend the discovery deadline to November 28, 2025. PAPERLESS ORDER. THIS MATTER is before the Court on the Parties' Joint Unopposed Motion for Extension of Time to Disclose Expert, Expert Witness Summaries and Reports (DE #53 ) ("Joint Motion"). In the Joint Motion, the Parties request extensions of time to comply with the expert disclosure and expert report deadlines. As the Motion was filed two days after Plaintiff's deadline, the Motion fails to comply with the Court's Practices and Procedures, which state that "[a]bsent an emergency, requests for extensions of time must be presented to the Court, by motion, no later than 48 hours prior to the deadline from which the Parties are seeking relief. Sanctions may be imposed for non-emergent requests made less than 48 hours prior to the deadline." Further, the Court finds the Parties have failed to satisfy "good cause" or "excusable neglect." As the Court may "hold litigants to the clear terms of the scheduling order," Josendis v. Wall to Wall Residence Repairs, Inc., 662 F.3d 1292, 1307 (11th Cir. 2011), upon review of the Joint Motion, the record, and applicable law, it is ORDERED AND ADJUDGED that the Parties' Joint Motion (DE #53 ) is DENIED. PAPERLESS ORDER. THIS MATTER is before the Court on Plaintiff's Amended Unopposed Motion for Extension of Time to Select Mediator and Schedule Mediation (DE #34 ) ("Motion"). In the Motion, Plaintiff seeks a twenty (20) day extension of time to file the Parties' notice scheduling mediation. As the amended Motion was filed the day after the deadline, the Motion fails to comply with the Court's Practices and Procedures, which state that "[a]bsent an emergency, requests for extensions of time must be presented to the Court, by motion, no later than 48 hours prior to the deadline from which the Parties are seeking relief. Sanctions may be imposed for non-emergent requests made less than 48 hours prior to the deadline." Additionally, Plaintiff's vague justification satisfies neither excusable neglect nor good cause. See Payne v. C.R. Bard, Inc., 606 F. App'x 940, 944 (11th Cir. 2015) ("A party seeking the extension of an already-expired scheduling order deadline must showing both good cause and excusable neglect."). Nevertheless, because the Motion is unopposed, it is ORDERED AND ADJUDGED that the Motion (DE #34 ) is GRANTED IN PART.
