PAPERLESS ORDER Granting Plaintiff's #26 Motion for Leave to File an Amended Complaint. Plaintiff seeks to cure pleading defects raised by Defendant's #16 Motion to Dismiss by filing an amended complaint pursuant to Fed. R. Civ. P. 15(a)(2). See Heard v. Publix Supermarkets Inc., 808 F. App'x 904, 905-06 (11th Cir. 2020) (citations omitted).Defendant argues that granting Plaintiff leave to amend would be futile for three reasons: that there was no consideration exchanged between the parties sufficient to form a contract; that the National Traffic and Motor Vehicle Safety Act, 49 U.S.C. 30100 et seq., bars Plaintiff's recall-based contract and estoppel claims; and that Plaintiff's negligence claim is barred by the economic loss rule. Defendant also objects to Plaintiff's #26 Motion for failing to attach a copy of the proposed amendment to the Motion, as required by Local Rule 15.1 of the Southern District of Florida. See S.D. Fla. L.R. 15.1 ("A party who moves to amend a pleading shall attach the original of the amendment to the motion in the manner prescribed by Section 3I(1) of the CM/ECF Administrative Procedures.").The Court finds that justice requires permitting Plaintiff to file an amended complaint, notwithstanding Plaintiff's failure to strictly comply with the Local Rule. See Fed. R. Civ. P. 15(a)(2). Accordingly, Plaintiff's #26 Motion is GRANTED. Plaintiff shall file an amended complaint by no later than October 10, 2025. Defendant shall file its response within FOURTEEN (14) DAYS of service of the amended complaint. If Plaintiff seeks to replead allegations relating to his breach of contract, promissory estoppel, and negligence claims, he should consider the arguments raised by Defendant's #28 Response to Plaintiff's Motion for Leave to Amend, as well as those raised by Defendant's #16 Motion to Dismiss.
