| Filing 35 PAPERLESS ORDER striking #30 Joint Stipulation to Extend Time to Answer, Move, or Otherwise Respond to the Complaint. Without asking for leave of Court and apparently assuming that the Parties have control over the Court's docket and also possess the power to unilaterally decide to create their own enlargements of time to deadlines established by the Federal Rules of Civil Procedure, the Parties filed a stipulation purporting to supersede existing deadlines. Not surprisingly, the Parties have not cited any legal authority to support the filing of a stipulation. Based on the theory implicit in this highly unorthodox and unauthorized procedure, the Parties could conceivably file a stipulation giving Defendants years to file a response and affording Plaintiffs even more years to file a reply. These enlargements would be outrageous, to be sure, but there is no analytical distinction between this hypothetical stipulation and the one filed here. Other than the length of the self-gifted enlargements, there is no meaningful distinction between the two.Ignoring for the moment the threshold illogic and chutzpah underlying the stipulation, the submission is problematic for other reasons.First, the joint stipulation provides that Huntington National Bank's ("Huntington") "deadline to move to dismiss, answer, or otherwise respond to the Complaint will be no earlier than September 5, 2025" and that "Plaintiff's deadline to respond to any motion to dismiss filed by Huntington will be no earlier than October 27, 2025." The language of the stipulation creates ambiguity as to when Huntington's response to the Complaint will be due, because it theoretically could be filed on September 5, 2025 or October 26, 2025, and it would still be timely. The same is true for Plaintiff's response deadline, which, under the wording of the stipulation, would be timely on October 27, 2025, or anytime thereafter. Second, the Undersigned is not inclined to grant an extension of time for a motion which has not been filed yet (and may never be filed).Third, the stipulation does not explain why Huntington needs a 58-day extension of time to respond to the Complaint (other than stating that this is "a reasonable amount of time to respond to the Complaint" and that "a unified response date will create efficiency for the Court and the parties by reducing duplicative motion practice"). But the stipulation (which is signed by only Plaintiff and Huntington's counsel) does not state that the other Defendants agree with the stipulated terms.Finally, the Parties should reconsider the length of the enlargement they will seek if they file the required motion. Here is the general perspective: the longer the requested enlargement, the less likely it is to be granted. The Parties should provide cogent, specific and logical reasons for any enlargement of time requested beyond the garden-variety request of ten or 14 days. A motion, of course, can be denied or granted only in part. Because our Court prides itself on timely resolving civil lawsuits and because many believe in the maxim that "justice delayed is justice denied," the Parties should pause before seeking substantial enlargements of time.The Parties' stipulation-approach runs afoul of Judge Williams' Court Practices and Procedures, providing that "[s]trict compliance with all deadlines--whether set by court order or under the Federal and Local Rules--is mandatory" and that "[r]equests for extension of time will only be granted by the Court upon an appropriate motion showing good cause why the deadline cannot be met." See Judge Williams' Court Practices and Procedures (available at the Court's website: https://www.flsd.uscourts.gov/content/judge-kathleen-m-williams). Importantly, it requires that "[a]bsent an emergency, requests for extensions of time must be presented to the Court, by motion, no later than 48 hours prior to the deadline from which the Parties are seeking relief." Id. (bold emphasis in original; underline emphasis added). Id. See Coppel v. SeaWorld Parks & Ent., Inc., No. 21-CV-1430-RSH-DDL, 2024 WL 5337347, at *4 (S.D. Cal. Mar. 1, 2024) (finding that "unilateral reservations and agreements [were] without legal force absent the [c]ourt's approval" where (among other things), the court had a "Chambers Rules" which provided that "'[t]he parties may not unilaterally extend [discovery] deadlines by stipulation or by service of amended or supplemental responses" and "[a]ny extension require[d] leave of [c]ourt upon a showing of good cause.'"). The Undersigned will not permit the parties to sidestep Judge Williams' Court Practices and Procedures by filing a stipulation in lieu of asking the Court for permission (in the form of a motion, demonstrating good cause).Any future request for extension of time will be made in the form of a motion (not a stipulation), supported by a memorandum of law (if appropriate), set forth good cause for the requested extension, and be in compliance with Judge Williams' 48-hour rule (or demonstrate good cause why the 48-hour rule could not be met).
