PAPERLESS ORDER on Plaintiff's Ex Parte Emergency Motion for Temporary Relief and Evidentiary Protection (the "Motion"), ECF No. 23 . In the Motion, Plaintiff requests emergency relief in the form of a restraining order relating to a child support enforcement order entered in 2006. See ECF No. 23 at 2. As a threshold matter, the Court finds that Plaintiff's Motion does not present a bona fide emergency. Plaintiff has known of the relevant facts giving rise to this request for nearly 19 years, and to the extent Plaintiff's Motion vaguely references other conduct in the Verified Complaint, that conduct also dates back to 2007 (wage garnishment, driver's license suspension, and negative credit reports), 2008 to 2023 (IRS refund seizures), and 2019 (denial of a passport). See ECF No. #1 at 11. Under these circumstances, the urgency claimed is of Plaintiff's own making. This case bears strong resemblance to Spimerica Access Sols., LLC v. Palazzani Industrie, S.P.A., No. 23-23222-CIV, 2023 WL 5748160 (S.D. Fla. Sept. 6, 2023), in which the Court denied emergency relief in part because the record indicated that the plaintiff had known about the alleged emergency for at least one month and delayed in seeking judicial intervention. Id. at *1-2. Further, the Court outlined the types of circumstances that may constitute bona fide emergencies as follows: Bona fide emergencies involve the health and safety of individuals, the impending departure of a witness with no plans to return to the jurisdiction, the imminent destruction of a building or other property, the imminent deportation of an individual to another country, the need to give critical medical treatment to a patient in a hospital, the threatened loss of civil rights, the immediate, threatened loss of an entire business, or when someone is at risk of being denied an essential service. Id. (quoting Companhia Energetica Potiguar v. Caterpillar Inc., 2016 WL 7469993, at *3 (S.D. Fla. Apr. 13, 2016)). The circumstances here do not rise to the level of an emergency under this District's standards. Nothing in the record suggests that immediate, irreparable harm is imminent in a legally cognizable way, or that any harm alleged could not have been addressed through more diligent action earlier in time. Accordingly, Plaintiff's request for consideration of the Motion on an emergency basis is DENIED. The Court will take up the Motion in due course as a non-emergency matter.
