Filing 23
PAPERLESS ORDER striking #15 Motion for Clarification. THIS MATTER is before the Court sua sponte. On September 29, 2025, Plaintiff filed a notice (DE #15 ) purporting to request that the Court alter the 4(m) deadline to run from the date the summons were issued rather than from the date the Complaint was filed. Plaintiff states, without citing any supporting authority, that "Courts uniformly hold that Rule 4(m)'s clock is tolled while IFP applications are pending and service cannot be effected." Plaintiff provides no authority for her proposition. With limited exceptions, a request for relief must be supported by legal authority. See S.D. Fla. L.R. 7.1(a)(1); see also Flanigan's Enters., Inc. of Ga. v. Fulton Cnty., Ga., 242 F.3d 976, 987 (11th Cir. 2001) (holding that a party waives an argument if the party "fail[s] to elaborate or provide any citation of authority in support" of the argument). Plaintiff is reminded that pro se litigants must abide by "the relevant law and rules of court, including the Federal Rules of Civil Procedure." Moon v. Newsome, 863 F.2d 835, 837 (11th Cir. 1989). Signed by Judge Kathleen M. Williams on 10/3/2025. (ah06)
