PAPERLESS ORDER GRANTING the #38 Joint Motion to Set Briefing Schedule. The parties have asked us to set a briefing schedule on the Plaintiffs' #31 Motion to Remand and the Defendants' forthcoming Motion to Compel Arbitration. Based on the parties' agreement, we ORDER that the Defendants must respond to the Motion to Remand by September 12, 2025, and the Plaintiffs must file any reply in support of that Motion by September 19, 2025. The Defendants tell us that by September 19, 2025, they'll move to compel arbitration. The parties agree that, because of the Jewish holidays, the Plaintiffs should receive an extension of time to oppose that motion. They can't, however, agree on how long that extension should be. The Plaintiffs want to file their opposition on October 17, 2025; the Defendants want October 13, 2025. Also, the Defendants tell us that they believe service of process hasn't been perfected, and that the parties are discussing waivers of service. Although we don't think giving the Plaintiffs four more days would make any sort of difference, we don't currently see the need for the Defendants to move to compel arbitration at all. The Plaintiffs' Motion to Remand could dispose of this entire case. Accordingly, the Defendants must file their motion to compel arbitration within fourteen days of our decision on the Motion to Remand. The Plaintiffs must respond to that motion within fourteen days of when it's filed, and the Defendants must file any reply in support of that motion within seven days of the Plaintiffs' response. Finally, by September 26, 2025, the parties must jointly file a report explaining the current status of their service dispute (if they haven't resolved it by then). In the meantime, because the parties seem to agree that we shouldn't advance the case until we decide the threshold subject-matter jurisdiction and arbitrability issues, we'll CLOSE this case. PAPERLESS ORDER. The Plaintiffs in this removed action filed a #4 Motion for Preliminary Injunction seeking to enjoin an arbitration commenced by the Defendants. In it, they state that "immediate relief is requested by" today, "August 20, 2025." But the Plaintiffs aren't entitled to a decision on their Motion until it's fully briefed. As a threshold matter, the Plaintiffs haven't properly requested emergency relief. "A filer requesting emergency relief must include the words 'Emergency Motion' in the title of the motion and must set forth in detail the nature of the emergency, the date by which a ruling is necessary, and the reason the ruling is needed by the stated date." S.D. Fla. L.R. 7.1(d)(1). Additionally, "[t]he filer must certify that the matter is a true emergency by" averring, among other things, that the motion "requires an immediate ruling because the Court would not be able to provide meaningful relief to a critical, non-routine issue after the expiration of seven days." Ibid. The Motion isn't titled "Emergency Motion," and there's no certification of a true emergency. The Motion also fails to explain why we need to rule on it before briefing. It vaguely complains of some requirement that the Plaintiffs respond to emergency requests in the arbitration, and also of an August 26, 2025, hearingon what, the Plaintiffs don't say. Neither of those things justify ruling on an unripe motion. Despite the Plaintiffs' insistence to the contrary, an arbitrator can't "usurp" our jurisdiction. If the Plaintiffs are right that they were coerced into signing an agreement compelling them to participate in arbitration, we'll (most likely) enjoin the arbitral proceedingsno matter what phase they're in at the time we rule. Unsurprisingly, the Plaintiffs cite no contrary case law. In fact, they cite two cases from our District in which the injunction motions were grantedbut only after full briefing and an evidentiary hearing. Martucci v. LKE LLC, 2024 WL 4003726, at *1 (S.D. Fla. July 23, 2024) (Williams, J.); UBS Fin. Servs. Inc. v. Bounty Gain Enters. Inc., 2016 WL 1541438, at *1 (S.D. Fla. Apr. 11, 2016) (Matthewman, J.) (describing case history and denying the defendant's motion to set aside the order granting the preliminary injunction). For these reasons, we'll address the Motion after it's fully briefed.
