PAPERLESS ORDER striking #16 and #17 First Amended Complaint. On October 24, 2025, the Court affirmed and adopted Magistrate Judge Marty Fulgueira Elfenbein's Report and Recommendation, [ECF No. 6], and dismissed this case without prejudice for lack of subject-matter jurisdiction. [ECF No. 10]. Since the October 24, 2025 Order, the Court has informed Plaintiff that there is no further action to be taken in this matter, [ECF No. 13], and cautioned that future frivolous filings may result in the Court directing the Clerk not to accept said filings, except in very limited circumstances, [ECF Nos. 15]. Plaintiff, however, has ignored these warnings and continues to engage in frivolous filings. [ECF Nos. 11, 12, 14, 16, and 17]. Plaintiff must desist with his abusive and frivolous filings. Failure to obey this final warning will result in the Court placing Plaintiff on the "restricted filer" list and ordering the Clerk not to accept any future pro se filings from Plaintiff in this case. PAPERLESS ORDER striking #14 Plaintiff's Objections, Response, and Suggestions to Report and Recommendation ("Objections"). On October 24, 2025, the Court affirmed and adopted Magistrate Judge Marty Fulgueira Elfenbein's Report and Recommendation ("Report"), [ECF No. 6], and dismissed this case without prejudice for lack of subject-matter jurisdiction. [ECF No. 10]. Accordingly, there is no further action to be taken in this matter. Id. at 2. However, since this case's dismissal, Plaintiff has filed an Amended Complaint, [ECF Nos. 11 and 12], which the Court struck on October 28, 2025 with the warning that "[a]ny additional filings will be stricken without further notice," [ECF No.13]. Plaintiff proceeded to then file, on October 30, 2025, Objections to the Report, which was filed by Magistrate Judge Marty Fulgueira Elfenbein on October 9, 2025. The Report states that Plaintiff has "fourteen (14) days from the date of being served with a copy of this Report and Recommendation within which to file written objections, if any, with the assigned United States District Judge." Accordingly, Plaintiff's Objections are untimely.Plaintiff is further cautioned that future frivolous filings may result in the Court directing the Clerk not to accept said filings, except in very limited circumstances. Soler v. Fannie Mae, No. 18-22989-CIV, 2018 WL 11650332, at *3 (S.D. Fla. July 25, 2018) (identifying plaintiffs as repeat filers and issuing a warning on future frivolous filings).
