PAPERLESS ORDER striking Plaintiff's Motion for Default Final Summary Judgment Against Defendants Wade C. Timmerson and PG11, LLC (DE #16 ) ("Motion"). Plaintiff conflates the default judgment standard under Federal Rule of Civil Procedure 55(b) with the summary judgment standard under Federal Rule of Civil Procedure 56, and therefore, does "not address the issues necessary to determine whether default judgment is appropriate--i.e., whether the well-pleaded facts, taken as true, establish liability." See Great Am. Ins. Co. v. Delphini Constr. Co., No. 3:20-cv-784-MMH-MCR, 2015 WL 13791707, AT *2 (M.D. Fla. Sept. 28, 2015) (declining to construe plaintiff's motion for summary judgment as a motion for default judgment).
