Defendants' certificate of conferral indicates that Plaintiff opposes the requested relief. The Court ordered Plaintiff to file, by June 10, 2026, a response stating the reasons for the opposition (DE 71). Plaintiff did not file a response. Accordingly, Defendants' Joint Motion for Extension of Time (DE 70) is GRANTED. Defendants shall file their response to Plaintiff's Motion for Leave to file Third Amended Complaint by June 17, 2026. PAPERLESS ORDER. This cause is before the Court on pro se Plaintiff's Motion for Leave to File Sur-Reply to Defendants' Motion to Dismiss filed on April 22, 2026 (DE 59). Plaintiff requests leave to file a sur-reply to Defendants' Motion to Dismiss, because Defendants "raise new arguments and characterizations not presented in their Motion..." (id. at 1). Additionally, Plaintiff claims that a sur-reply "will assist the Court by addressing local waiver/abandonment claims... [and] clarifies the records and corrects multiple mischaracterizations" (id.). Defendants argue that no new arguments were raised in their reply, and Plaintiff is simply seeking to reargue matters presented in the Motion that "Plaintiff did not properly or thoroughly address in his first Response" (DE 61 at 1). Under Local Rule 7.1(c), briefing consists of the motion, a response in opposition, and a reply. Any further briefing requires leave of Court. See S.D. Fla. Local Rule 7.1(c). Plaintiff argues that a sur-reply is needed because Defendants' Reply raised new arguments not previously advanced in the Motion. But, the Court has reviewed the Reply and disagrees that Defendants advanced new arguments not set forth in the initial Motion. And to the extent that the Court needs issues clarified, it will call for supplemental briefs from the Parties in its discretion. Since Plaintiff fails to identify a valid reason to permit a sur-reply, additional briefing is not warranted. See First Specialty Ins. Corp. v. 633 Partners, Ltd., 300 F. App'x 777, 788 (11th Cir. 2008) ("A district court's decision to permit the filing of a surreply is purely discretionary and should generally only be allowed when 'a valid reason for such additional briefing exists, such as where the movant raises new arguments in its reply brief.'" PAPERLESS ORDER denying #20 Expedited Motion to Vacate Order Granting Defendants Motion for Extension of Time. On December 29, 2025, we granted the Defendant an extension of time to respond to the Plaintiffs twenty-eight-count complaint, see Paperless Order Granting Motion for Extension of Time [ECF No. 7], given the defense counsels pre-planned travel and holiday-related family commitments and the time required to respond to and provide a fulsome analysis of the twenty-eight counts alleged in the operative Complaint. Motion for Extension of Time [ECF No. #3 ]. Despite the Plaintiffs objections to that order, we find that the Defendants justifications provided good cause to grant an extension under Federal Rule of Civil Procedure 6(b)(1). Moreover, district courts have unquestionable authority to control their own dockets, including broad discretion in deciding how best to manage the cases before them. Smith v.
