PAPERLESS ORDER granting #56 Plaintiffs' Partially Unopposed Motion for Extension of Deadline to Amend Pleadings. On June 8, 2026, the Court granted Plaintiffs leave to amend their Complaint on or before June 18, 2026. [ECF No. 52]. On June 17, 2026, Plaintiffs filed the instant Motion for Extension of Deadline to Amend Pleadings ("Motion"), [ECF No. 56]. Plaintiffs seek to add another Defendant--B3 Event Services, LLC--because "on June 5, 2026, for the first time IPS' counsel disclosed that some of the security guards which were involved in the subject incident were IPS employees who had been leased to B3 Event Services, LLC" and "IPS did not disclose the involvement of B3 in this incident until June 5, 2026, which was 15 days after the deadline for adding new parties." See Mot. at 1-2. Plaintiffs indicate that "Defendant IPS does not oppose the Motion and Defendants South Florida Stadium and Rolling Loud have not indicated their position at the time of the filing of the Motion." Id. at 4. "A schedule may be modified only for good cause and with the judge's consent." Fed. R. Civ. P. 16(b)(4). Here, the deadline for parties to amend their pleadings was May 20, 2026, less than a month before Plaintiffs filed the instant Motion. See Order Setting Jury Trial Schedule, Requiring Mediation, and Referring Certain Matters to Magistrate Judge, [ECF No. 27] at 2. Thus, Plaintiffs must demonstrate good cause for the amendment. If Plaintiffs make a showing of good cause, the Court then turns to Rule 15(a)(2) which provides that courts "should freely give leave when justice so requires." Fed. R. Civ. P. 15(a)(2); see also Sosa v. Airprint Sys., Inc., 133 F.3d 1417, 1419 (11th Cir. 1998) ("[B]ecause Sosa's motion to amend was filed after the scheduling order's deadline, she must first demonstrate good cause under Rule 16(b) before we will consider whether amendment is proper under Rule 15(a)."). "[T]he court may modify the schedule on a showing of good cause if it cannot reasonably be met despite the diligence of the party seeking the extension." Fed. R. Civ. P. 16 advisory committee's note to 1983 amendment. Diligence is evaluated by considering "(1) whether the plaintiff failed to ascertain facts prior to filing the complaint and to acquire information during the discovery period, (2) whether the information supporting the proposed amendment was available to the plaintiff, and (3) whether even after acquiring the information the plaintiff delayed in seeking the amendment." Sassine v. Seven for all Mankind, LLC, No. 22-23221, 2023 WL 2132917, at *2 (S.D. Fla. Feb. 21, 2023) (citing Sosa, 133 F.3d at 1419). Plaintiffs explain that they did not learn of B3 Event Services' involvement until June 5, 2026, as "IPS had not identified B3 or its employees in its initial or supplemental Rule 26 disclosures." Mot. at 2. Moreover, "the full extent of B3's involvement is not yet known as IPS has yet to comply with the Order compelling discovery" following a hearing before Magistrate Judge Louis on June 9, 2026. Id. As such, Plaintiffs' failure to add B3 as a Defendant prior to May 20, 2026 cannot be attributed to Plaintiffs' lack of diligence. Plaintiffs have thus shown good cause. Because Plaintiffs have shown good cause as required by Rule 16, the Court turns to the Rule 15 inquiry. Rule 15(a)(2) provides that "[t]he court should freely give leave when justice so requires." Fed. R. Civ. P. 15(a)(2). "The decision whether to grant leave to amend is committed to the sound discretion of the district court." Cannon v. Macon Cnty., 1 F.3d 1558, 1566 (11th Cir. 1993). Leave should be "freely given" absent a reason such as "undue delay, bad faith or dilatory motive on the part of the movant, repeated failure to cure deficiencies by amendments previously allowed, undue prejudice to the opposing party by virtue of allowance of the amendment, [or] futility of amendment." Foman v. Davis, 371 U.S. 178, 182 (1962). None of those reasons are present here. Further, Defendant IPS does not oppose the instant Motion. See Mot. at 4. And although Defendants South Florida Stadium and Rolling Loud have not indicated their position on the Motion, the Court will "freely grant" leave nevertheless given Rule 15's lax standard. Accordingly, Plaintiffs' Motion, [ECF No. 56], is GRANTED. Plaintiffs shall file their Second Amended Complaint on the public docket on or before June 18, 2026, which Plaintiffs shall serve on Defendant B3 Event Services, LLC within ninety (90) days of filing. See Fed. R. Civ. P. 4(m). All Defendants shall file a single, combined response or separate answers within twenty-one (21) days of service on Defendant B3 Event Services, LLC. Nor are the efforts to confer sufficiently described; Local Rule 7.1(a)(3) requires more specificity concerning conferral attempts: At the end of the motion, and above the signature block, counsel for the moving party shall certify either: (A) that counsel for the movant has conferred with all parties or non-parties who may be affected by the relief sought in the motion in a good faith effort to resolve the issues raised in the motion and has been unable to do so; or (B) that counsel for the movant has made reasonable efforts to confer with all parties or non-parties who may be affected by the relief sought in the motion, which efforts shall be identified with specificity in the statement (including the date, time, and manner of each effort), but has been unable to do so. The Motion will not be adjudicated until the deficiency is cured. Accordingly, and by no later than Wednesday, May 27, 2026, Plaintiffs shall file an amended conferral certification which complies with Local Rule 7.1(a)(3). [ECF No. 18].On February 28, 2026, Defendant IPS Nationwide, Inc. asked the Court to "stay the matter for 30 days to allow all counsel to make appearances so that compliance with the Order may be possible, or allow the parties relief from the [Order Requiring Combined Responses] altogether." [ECF No. 19] at 4. However, it appears that all Defendants have entered appearances in this case, as Defendants Rolling Loud, LLC and South Florida Stadium, LLC jointly moved for an extension of time on February 27, 2026. See [ECF No. 17].Accordingly, the Court will not stay the case but will allow all Defendants additional time--until on or before March 13, 2026--to file a single combined response or separate answers to Plaintiff's Amended Complaint. As such, Defendant IPS Nationwide, Inc.'s Motion to Dismiss, [ECF No. 18], is DENIED without prejudice.
