PAPERLESS ORDER. THIS MATTER is before the Court sua sponte. On March 9, 2026, the Court entered the Scheduling Order (DE #20 ) in this matter, which states in relevant part: "Within thirty (30) days of the date of this Order, the Parties shall: (1) select a certified mediator from the Certified Mediator List maintained by the Southern District of Florida pursuant to Local Rule 16.2(b) and available on the Court's website under Attorney Resources."On April 8, 2026, the Parties filed their Notice of Mediation (DE #22 ), designating Manuel R. Morales, Jr. as the Mediator. However, it does not appear that Manuel R. Morales, Jr.'s name is included on the Southern District of Florida's Certified Mediator List, which is available online at www.flsd.uscourts.gov/mediation.Accordingly, it is ORDERED AND ADJUDGED as follows:On or before 12:00 P.M. on April 10, 2026, the Parties shall jointly file a notice on the docket, stating: (1) whether Manuel R. Morales, Jr. is certified as a mediator in the Southern District of Florida; (2) if Manuel R. Morales, Jr. is certified, why their name does not appear on the Certified Mediator List; and (3) if they are not certified, why the Parties selected an uncertified mediator without first seeking leave of Court to do so.If Manuel R. Morales, Jr. is not certified as a mediator in the Southern District of Florida, but the Parties believe the specific circumstances of this case warrant the use of a mediator not on the Certified Mediator List, they should file a motion for leave of Court to select an uncertified mediator, as required by the Court's Scheduling Order (DE #20 ).Moving forward, it is imperative that the Parties fully comply with the Federal Rules of Civil Procedure, the Local Rules for the Southern District of Florida, the Court's Practices and Procedures, and all Court orders.
