PAPERLESS ORDER. THIS CAUSE came before the Court upon Petitioner Jackson Jacques's Notice of Voluntary Dismissal of Petition for Writ of Habeas Corpus. #31 . Therein, Petitioner seeks to voluntarily dismiss his Petition because he has decided to voluntarily depart for Mexico. See id. at 1. Federal Rule of Civil Procedure 41(a)(1) allows a plaintiff to voluntarily dismiss a claim (1) prior to a defendant's filing of an answer or a motion for summary judgment, or (2) by filing a stipulation of dismissal signed by all parties who have appeared. Fed. R. Civ. P. 41(a)(1). If dismissal is not proper under Rule 41(a)(1), "an action may be dismissed at the plaintiff's request only by court order, on terms that the court considers proper." Fed. R. Civ. P. 41(a)(2).Here, Respondents have filed a Response (ECF No. 22) to the Court's Order to Show Cause (ECF No. 5) and thus Petitioner cannot voluntarily dismiss his Petition (ECF No. 1) without Court order. See Fed. R. Civ. P. 41(a)(1)-(2). For the reasons described in the Notice, the Court finds that dismissal is proper in this instance to permit Petitioner to voluntarily depart from the United States. See (ECF No. 31) at 1. Accordingly, UPON CONSIDERATION of the Notice, the pertinent portions of the record, and being otherwise fully advised in the premises, it is ORDERED AND ADJUDGED that this case is hereby DISMISSED WITHOUT PREJUDICE as to Petitioner Jackson Jacques. The Court's Order to Show Cause (ECF No. 5) is hereby VACATED as to Petitioner Jackson Jacques only. THIS CAUSE came before the Court upon Petitioner Emmanuel Vallejo Ramirez's Motion for Leave to File Late Memorandum. 6. Therein, Petitioner appears to be responding to Judge Raag Singhal's Order dated March 16, 2026, before whom Petitioner's case was previously pending, and seeks leave to file out of time because there were delays in receiving and sending mail as well as obtaining legal assistance at the law library. See id. at 1-2. Judge Singhal provided Petitioner until March 30, 2026 to file an amended petition, without mention of the prison mailbox rule or any other mechanism that would allow for a late filing. See Order at 3, Ramirez v. Noem, No. 26-cv-21637-SINGHAL (S.D. Fla. Mar. 16, 2026) (ECF No. 7). Thus, while the relief which Petitioner seeks does not relate to the instant case before this Court, Judge Singhal's case is now closed and Petitioner may not make any further filings therein so the Court will also not direct Petitioner's Motion to be refiled therein. Accordingly, UPON CONSIDERATION of the Motion, the pertinent portions of the record, and being otherwise fully advised in the premises, it is hereby ORDERED AND ADJUDGED that the Motion 6 is DENIED AS MOOT.Nevertheless, in light of Petitioner's pro se status, to the extent he wishes his memorandum to be considered in the instant action, the Court will so consider. However, this case has been consolidated with Case No. 1:26-cv-21770 as the lead case, and as previously directed all future filing must be made only in the lead case. (ECF No. 4).
