Because the parties have consented to refiling this action in Massachusetts state court, the Defendants primary forum non conveniens argument [has] been mooted... [and] no further purpose would be served by further briefing of Defendants Motion to Dismiss. Ibid. In light of the foregoing, we DENY without prejudice the Defendants Motion to Dismiss.
