February 21, 2019 Opinion or Order Filing 7 PAPERLESS ORDER denying #5 Motion for Preliminary Injunction. Plaintiff's motion as currently pled is insufficient. The court cannot discern from the motion who plaintiff is seeking the injunction against, nor are the allegations clear from the pleadings. For example, it appears as though plaintiff is requesting the enforcement of an injunctive order already in place, however he does not explain what "injunctive order" he is referring to. Because the court cannot follow the plaintiff's motion, it cannot grant it at this time. February 21, 2019 Opinion or Order Filing 6 PAPERLESS ORDER denying #4 Motion to Appoint Counsel; denying #4 Motion for Hearing. In determining whether to appoint counsel, [t]he key is whether the pro se litigant needs help in presenting the essential merits of his or her position to the court. Where the facts and issues are simple, he or she usually will not need such help. Kilgo v. Ricks, 983 F.2d 189, 193 (11th Cir. 1993). Thus, whether a case presents exceptional circumstances warranting the appointment of counsel depends on (1) the type and complexity of the case; (2) whether the pro se litigant is capable of adequately presenting her case; (3) whether the litigant is in a position to adequately investigate the case; and (4) whether the evidence will consist in large part of conflicting testimony so as to require skill in the presentation of evidence and in cross-examination. See Ulmer v. Chancellor, 691 F.2d 209, 213 (5th Cir. 1982) (incorporated by Fowler v. Jones, 899 F.2d 1088, 1096 (11th Cir. 1990)).After reviewing this case, the Court finds that, at this juncture, no compelling circumstances require the extraordinary procedure of seeking counsel for Plaintiff.
