Filing 8 ORDER Closing Case. Signed by Judge Robin L. Rosenberg on 6/14/2019. See attached document for full details. (vmz) |
Filing 7 PAPERLESS ORDER dismissing Complaint. This matter comes before the Court on a sua sponte review of the Complaint for subject matter jurisdiction. See Univ. of S. Ala. v. Am. Tobacco Co., 168 F.3d 405, 410 (11th Cir. 1999) (stating that "a court should inquire into whether it has subject matter jurisdiction at the earliest possible stage in the proceedings" and that "a federal court is obligated to inquire into subject matter jurisdiction sua sponte whenever it may be lacking"). Plaintiff bases this Court's subject matter jurisdiction on diversity of citizenship. See DE 1 at 2. However, Plaintiff has failed to adequately plead the citizenship of Defendant State Farm Insurance. See Wachovia Bank v. Schmidt, 546 U.S. 303, 318 (2006) (stating that "a corporation's citizenship derives, for diversity jurisdiction purposes, from its State of incorporation and principal place of business"). Plaintiff alleges only that Defendant State Farm Insurance "is a corporation authorized to do business and doing business in Orange County, Florida." See DE 1 at 1. Consequently, the Court dismisses the Complaint and orders Plaintiff to file an Amended Complaint by no later than June 7, 2019, that adequately pleads the parties' citizenship for the purpose of establishing diversity jurisdiction. Plaintiff's failure to file an Amended Complaint by June 7, 2019, may result in the dismissal of this action without further notice. Signed by Judge Robin L. Rosenberg on 5/31/2019. (sk01) |
