P. 65(b), a temporary restraining order may be granted without oral or written notice to the adverse party only if the moving party certifies any efforts made to give notice and the reasons why notice should not be required. The instant motion currently lacks that certification, and the proposed Defendants have not been served yet. Plaintiff also has not complied with Fed. R. Civ. P. 65(a), which requires notice to the adverse party to obtain a preliminary injunction. However, as the Defendants have not yet been served, there is no adverse party. Plaintiff is reminded that there is presently no operative complaint for Plaintiff to serve on the Defendants he seeks to bring into this action. [ECF No. #6 ]. He is further advised to remember that, as a prisoner, any amended complaint will be subject to the screening provisions of 28 U.S.C. 1915A, as he is not proceeding in forma pauperis.
