November 11, 2020 Opinion or Order Filing 7 PAPERLESS ORDER SETTING DEADLINE FOR FILING CLOSING DOCUMENTS AND EXTENDING DEADLINE FOR DEEFNDANT TO RESPOND TO COMPLAINT. The Parties have filed a Joint Notice of Settlement (DE #6 ), and the Court congratulates them on their early and amicable resolution of this matter. The Parties are directed to file appropriate dismissal documents within 10 days, or by November 19, 2020, at which time they may also move for the Court to retain jurisdiction upon closing the case if necessary to enforce the terms of their settlement agreement. As a reminder, such closing documents must include the Parties' fully executed FLSA settlement agreement for the Court's approval. The Parties are further advised that if they are not able to finalize their settlement agreement as planned, that fact alone shall not constitute good cause for extending any litigation deadline, as the Court does not view the filing of a notice of settlement as a basis to stay the ongoing litigation in its entirety. However, in view of the pending settlement, I will further extend the deadline for Defendants to answer the Complaint from November 11, 2020 to November 19, 2020. Signed by Judge Donald M. October 29, 2020 Opinion or Order Filing 5 PAPERLESS ORDER granting #4 Defendants' Unopposed Motion for Extension of Time. Defendants seek a 14-day extension of the deadline to respond to Plaintiff's complaint from October 28, 2020 to November 11, 2020. In support, Defendants' counsel represents that he was recently retained and "require[s] additional time to investigate and respond" to the Complaint. (DE #4 para. 3). Defendants' counsel further asserts that he and Plaintiffs are "actively currently exploring the potential for a non-litigated resolution of this action." (DE #4 para. 4). Motions for extension of time must set forth good cause supported by specific facts. This motion rests upon vague assertions which are conclusory and lack any meaningful factual explanation. However I will grant the motion because the requested extension is brief, the motion is not opposed, and extending this deadline may facilitate an early settlement of this matter. Accordingly, the deadline for Defendants to respond to the Complaint is extended to November 11, 2020. Future requests for extensions will be denied unless the moving party can establish that a particular deadline could not be met despite diligent efforts supported by particular facts.
