May 4, 2022 Opinion or Order Filing 4 PAPERLESS ORDER: This cause is before the Court upon an order referring Defendant's Emergency Motion to Quash and for Protective Order #1 to the undersigned for full disposition 3 . The Motion, filed yesterday evening, states that "Counsel for Mr. Shannon issued a subpoena on April 20, 2022, for a deposition to be conducted by Zoom in Port St. Lucie, Florida and served the same on April 27, 2022, on Mr. Pauciulo. Liberty Mutual became aware of service on Thursday, April 28, 2022. Mr. Pauciulo has been allegedly commanded to attend the deposition on May 5, 2022." The Motion is DENIED for the following reasons. First, this matter is not a true emergency, and Defendant provides no basis for its delay in waiting until 7:42 PM on May 3, 2022 to file the Motion when Defendant was on notice of the deposition as early as April 25, 2022 according to the correspondence attached to the Motion [1-3]. Second, Defendant failed to comply with S.D. Fla. L. R. 7.1(d)(1), which requires parties to certify emergency motions with mandatory language that must appear before the signature block. Third, Defendant failed to comply with Fed. R. Civ. P. 26(c) and S.D. Fla. L. R. 7.1(a)(3), which provide for mandatory, meaningful conferral. Local Rule 7.1(a)(3) provides that, "[p]rior to filing any motion in a civil case," counsel for the moving party shall certify that they have "confer[red] (orally or in writing), or ma[de] reasonable effort to confer (orally or in writing), with all parties or non-parties who may be affected by the relief sought in the motion in a good faith effort to resolve by agreement the issues to be raised in the motion." The rule requires that the certificate of conferral be located "[a]t the end of the motion, and above the signature block[.]" The Motion does not have a certificate of conferral. Even looking to the attached correspondence [1-3], the issues raised in the Motion have not been the subject of meaningful conferral. Accordingly, the Motion is DENIED.
