Date Filed Document Text
April 9, 2025 Opinion or Order Filing 24 PAPERLESS ORDER: The Court is in receipt of #23 Plaintiff's Motion for Clarification of Defendants' Response Deadlines and Service Status. First, in accordance with the Court's Order Requiring Combined Responses #22 , "no Defendant shall file a response or answer until all Defendants in this action have been served." That means no Defendant--even if that Defendant is already properly served--may file an answer or responsive motion until all Defendants have been properly served as reflected through proper proof on the docket. Second, the deadline for Plaintiff to properly effectuate service of process on all Defendants is May 29, 2025. Defendants United Music Group, Inc. and Republic Records have been served, as reflected by the executed summonses #7 [18 p.1] and acknowledged in their joint Motion for Extension of Time to Respond to Plaintiff's Complaint [9 p. 2]. The executed summons also indicates that Defendant Aaron Dessner was personally served on March 11, 2025 [18 p. 3] and that Defendant Jack Antonoff was served on March 7, 2025, via substitute service by leaving the documents with a permanent co-resident at his usual place of abode [18 p. 5]. Finally, while Plaintiff has until the May 29, 2025, service deadline to properly effectuate service of process on Defendant Taylor Swift, Plaintiff is reminded that she must comply with the applicable services statutes under Rule 4(e) of the Federal Rules of Civil Procedure (and any state service statutes applicable under that rule). See Fed. R. Civ. P. 4(e); Case No. 24-14153 Doc. 66. Nothing in this Order should be construed as a final determination on any service issue or service challenge in this case. Signed by Judge Aileen M. Cannon on 4/9/2025. (bbk)
