PAPERLESS ORDER denying #16 Plaintiff's Motion for Final Default Judgment. Plaintiff has failed to comply with my order of instructions regarding default judgment procedures. (See DE 14 ). Therein, I advised Plaintiff that the proposed order for final default judgment must contain "legal analysis as to the claims on which Plaintiff is seeking default final judgment and how the pled facts, taken as true, justify awarding Plaintiff default judgment." Plaintiff's proposed order is conclusory and sparse, wholly failing to address the legal requirements and factual basis for each of the six counts of the Complaint. Accordingly the Motion for Final Default Judgment is denied. The denial is without prejudice. If Plaintiff chooses to renew this motion and submit an appropriate proposed order, she must do so by February 10, 2026. If no renewed motion is filed by that deadline, this case will be dismissed. PAPERLESS ORDER re #17 Notice of Unavailability. Counsel for Plaintiff filed a Notice of Unavailability, therein representing that counsel will be unavailable on certain dates and requesting that no hearings and the like be scheduled on those dates. To the extent that Plaintiff's counsel sought an extension of any deadline or any other relief from the Court, I decline to grant any such relief based on the present record. Plaintiff is advised that, pursuant to Federal Rule of Civil Procedure 7(b)(1), "[a] request for a court order must be made by motion," which must "state with particularity the grounds for seeking the order." Fed. R. Civ. P. 7(b)(1). Counsel's "Notice of Unavailability" is not a motion and therefore I will not take any action upon it. PAPERLESS ORDER REGARDING DEFAULT JUDGMENT PROCEDURES. On December 10, 2025, Plaintiff moved for Clerk's Entry of Default against Defendant (DE #12 ). The motion was granted on December 11, 2025. (DE #13 ). Accordingly, if Plaintiff intends to move for default final judgment, she must do so on or before December 22, 2025. Moreover, Plaintiff is advised that pursuant to S.D. Fla. Local Rule 7.1(a)(2), motions for default judgment must be "accompanied by a proposed order that is filed and submitted via e-mail to the Court as prescribed by Section 3I(6) of the CM/ECF Administrative Procedures." The proposed order must contain legal analysis as to the claims on which Plaintiff is seeking default final judgment and how the pled facts, taken as true, justify awarding Plaintiff default judgment. Plaintiff must ensure that her proposed order with the court is emailed in Word format to the court's e-filing address: [email protected]. The return of service reflects that Defendant's Answer was due on September 23, 2025. To date, Defendant has not filed a response to the Complaint and no attorney has appeared on its behalf, and Plaintiff has filed nothing since initiating this case in August.
