November 17, 2020 Opinion or Order Filing 12 PAPERLESS ORDER denying #9 a letter the Court (very generously) construes as a motion for reconsideration under Fed. R. Civ. P. 59(e). In it, the Plaintiff "challenge[s] the constitutionality of the suspension of speedy and public trials." Id. The letter contains no other factual averments or legal citations of any kind. "The only grounds for granting a Rule 59 motion are newly-discovered evidence or manifest errors of law or fact." Arthur v. King, 500 F.3d 1335, 1343 (11th Cir. 2007) (cleaned up). Thus, parties "cannot use a Rule 59(e) motion to relitigate old matters, raise argument or present evidence that could have been raised prior to the entry of judgment." Michael Linet, Inc. v. Vill. of Wellington, Fla., 408 F.3d 757, 763 (11th Cir. 2005). In his Complaint [ECF No. #1 ], the Plaintiff had already challenged the state court's (alleged) violation of his speedy-trial rights, id. at 2. In its Order dismissing the Complaint, the Court characterized his argument on this issue as "plainly insufficient to state a viable claim." [ECF No. #6 ] at 3. In short, even construing the Plaintiffs letter as a proper legal filing, the Plaintiff cannot meet his burden under Rule 59. See Stone v. Wall, 135 F.3d 1438, 1442 (11th Cir. 1998) ("The purpose of a Rule 59(e) motion is not to raise an argument that was previously available, but not pressed."). Signed by Judge Roy K. Altman (bca)
