Filing 7 PAPERLESS ORDER REQUIRING a corporate disclosure statement pursuant to Federal Rule of Civil Procedure 7.1(a)(2). The Court is unable to discern whether it has subject matter jurisdiction over this action based on Defendants' Notice of Removal. [ECF No. 1]. In their Notice of Removal, Defendants Nutribullet, LLC and Capital Brands, LLC argue that the Court has original diversity jurisdiction over this action pursuant to 28 U.S.C. 1332. Id. Defendants assert that they are citizens of California, making Defendants and Plaintiff citizens of different states. Id. paras. 5, 8-12. Notably, however, both Defendants fail to identify their members and respective citizenship. As the Eleventh Circuit has explained, "a limited liability company is a citizen of any state of which a member of the company is a citizen" and, thus, "[t]o sufficiently allege the citizenship of [an LLC], a party must list the citizenships of all members of the limited liability company." Rolling Greens MHP, L.P. v. Comcast SCH Holdings L.L.C., 374 F.3d 1020, 1022 (11th Cir. 2004) (emphasis added). Thus, Defendants shall file their corporate disclosure statements on or before May 17, 2024. Signed by Judge Darrin P. Gayles on 5/10/2024. (bs00) |
