PAPERLESS ORDER granting in part #20 Joint Motion to Extend Discovery, Mediation, and Dispositive Motions Deadline. The Parties offer many reasons to justify their request to stay several significant deadlines: several deponents are not available until after the discovery deadline has passed, they have thus far been unable to schedule mediation, and Defendant's counsel has another trial the same week as the deadline for the Parties to file all pretrial motions. As the Joint Motion also explains, though, the Parties did not begin to engage in discovery until August 28, 2018, nearly three months after the Complaint was filed and two months after the Parties received the Pretrial Scheduling Order (DE #7 ). The Scheduling Order may be modified only "upon a showing of good cause." Fed. R. Civ. P. 16(b)(4). "This good cause standard precludes modification unless the schedule cannot 'be met despite the diligence of the party seeking the extension.'" Sosa v. Airprint Sys., Inc., 133 F.3d 1417, 1418 (11th Cir. 1998) (citing Fed. R. Civ. P. 16 advisory committee's note). I do not find that good cause has been shown to grant the broad relief requested here. However, because the Parties have asserted that several deponents are not available until after the discovery deadline, I will extend the discovery cut-off date to November 5, 2018. Also, in an effort to encourage the parties to meaningfully participate in mediation, I will extend the mediation deadline to December 10, 2018. The dispositive motions deadline will remain unchanged, as will all deadlines thereafter. The Parties are reminded that they may consent to the jurisdiction of United States Magistrate Judge Dave Lee Brannon, who generally allows the Parties great flexibility in setting the course and schedule, including the trial date, of their case.
