December 26, 2018 Opinion or Order Filing 5 PAPERLESS ORDER denying without prejudice Plaintiff's Motion to Appear in Forma Pauperis (IFP) [DE 2]. Plaintiff is ordered to file an amended IFP Motion with all applicable questions answered, including questions regarding Plaintiff's expenses. Furthermore, the Complaint [DE 1] is dismissed without prejudice. The Court finds that the Complaint as drafted does not allege a basis for subject matter jurisdiction or allege a statement of facts as required by Federal Rule of Civil Procedure 8. Federal courts are courts of limited jurisdiction, and only have subject matter jurisdiction over cases involving a federal question or with diverse parties. Here, the parties are not diverse because the Plaintiff appears to be a citizen of Florida and the Defendant is also a citizen of Florida. Accordingly, to maintain her case in federal court, Plaintiff must bring a claim that arises under federal law. In addition, Plaintiff must allege the facts that have given rise to this lawsuit, including the relationship between Plaintiff and the minors Plaintiff claims did not receive appropriate services from Defendant. If Plaintiff wishes to pursue this case in federal court, she is ordered to file an amended complaint, including a statement of the Court's jurisdiction over the case and a statement of the facts of this case, by no later than January 21, 2019. If Plaintiff fails to timely file an amended complaint, the Court will close this case. If Plaintiff wishes to proceed IFP, she must also file her amended IFP motion by no later than January 21, 2019. Signed by Judge Robin L. Rosenberg on 12/26/2018. (kbs)
